Welcome to Pikozo! These Terms and Conditions ("Terms") govern your access to and use of the Pikozo mobile application ("App") and website ("Site") (collectively, the "Service") operated by Pikozo ("we," "our," or "us"). By using or accessing our Service, you ("you," "User," or "Customer") agree to these Terms. If you do not agree with these Terms, please do not use our Service.

Please read these Terms carefully, as they outline your rights, obligations, and limitations when using Pikozo.

01. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Service. By accessing or using Pikozo, you represent and warrant that you are eligible to use the Service and that you will comply with these Terms.

02. Account Registration

To access certain features of Pikozo, you may need to create an account. When registering, you agree to:

Provide accurate, current, and complete information.
Maintain the confidentiality of your account information and password.
Be responsible for all activity under your account, including unauthorized access.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

03. Services Provided

Pikozo provides an online platform for users to browse menus, place food orders, and receive delivery from participating restaurants or food vendors. We act as an intermediary between users and food providers, processing orders and facilitating payments. However, we do not own or operate the food providers.

04. Ordering Process

Placing Orders: By submitting an order through Pikozo, you agree to pay for the food items and any applicable taxes, fees, and delivery charges as displayed in the order summary.
Order Confirmation: Once an order is placed, we will send you a confirmation email or notification with the details of your order. However, we reserve the right to cancel any order in certain circumstances (e.g., unavailability of items, pricing errors, etc.).
Pricing: Prices for food items and services are as listed on the App or Site and are subject to change. Any changes in price will be communicated before you confirm your order.

05. Payment

Payment Methods: Pikozo accepts various payment methods, including credit/debit cards, digital wallets, and other approved methods. Payment will be processed through a third-party payment processor.
Refunds: If you are unsatisfied with your order or experience issues with your payment, please contact our customer service team. Refunds, if applicable, will be issued at our discretion based on the circumstances of your complaint.

06. Delivery

Delivery Availability: Delivery availability depends on your location and the participating food vendors. We will notify you if we cannot fulfill your order due to delivery limitations.
Delivery Times: Estimated delivery times are provided for guidance and are not guaranteed. Delays may occur due to factors beyond our control, such as traffic, weather, or restaurant delays.

07. User Conduct

You agree not to:

Violate any applicable laws or regulations.
Interfere with or disrupt the operation of the Service.
Engage in fraudulent or deceptive behavior, including misrepresenting your identity or payment information.
Use the Service for any unlawful or malicious purpose.

You agree to respect the rights and privacy of others, including other users and food providers, while using Pikozo.

08. Content Ownership and Intellectual Property

Ownership: The Service, including all text, graphics, logos, images, software, and content, is owned by Pikozo or its licensors and is protected by copyright, trademark, and other intellectual property laws.
License: Pikozo grants you a limited, non-transferable, non-exclusive license to use the App and Site for personal, non-commercial purposes in accordance with these Terms.

You may not reproduce, distribute, modify, or otherwise exploit any content from the Service without our express permission.

09. Privacy

Your use of Pikozo is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information in accordance with our Privacy Policy.

10. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by Pikozo. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party links at your own risk, and we encourage you to review their terms and policies.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, with or without notice, if you violate these Terms or engage in behavior that we deem harmful or inappropriate. Upon termination, you must immediately cease using the Service.

12. Disclaimers and Limitation of Liability

Service Availability: We strive to provide a reliable and uninterrupted Service, but we cannot guarantee that the App and Site will be available at all times, nor can we guarantee that they will be free from errors or defects.
Limitation of Liability: To the fullest extent permitted by law, Pikozo and its affiliates, employees, and partners are not liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service, including any delays or issues with food orders or deliveries. Our liability is limited to the amount paid for the relevant order, except where prohibited by law.
Food Quality and Safety: While we make efforts to ensure that food providers maintain high standards, Pikozo does not directly control the quality, preparation, or safety of the food. If you have concerns regarding allergies, dietary restrictions, or food safety, you are advised to contact the food provider directly.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pikozo, its affiliates, employees, agents, and licensors from any and all claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Changes to the Terms

Pikozo reserves the right to update or modify these Terms at any time. When we make changes, we will post the updated Terms on the App or Site and update the "Last Updated" date at the top. We encourage you to review these Terms periodically to stay informed about any changes.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes or claims arising out of or related to these Terms will be resolved in the competent courts of Gujarat, India.
